Environmental
Environmental law has earned crucial significance in business management: the principles of precaution and prevention require to constantly supervise the compliance with environmental standards set out by European and national laws. Furthermore, the management of environmental liabilities must be inspired by a strategic view to face with both technical and legal issues.
AM provides specific legal assistance for each Environmental Law area:
- Compliance and environmental prevention: consultancy on EU environmental law, also concerning the REACH regulation; and the most recent developments and opportunities of eco-innovation and circular economy; legal advice on financing and restoration and green-economy projects; managing of environmental risk insurance and planning; preparation of appropriate delegation systems within organizations and organizational models (Legislative Decree No. 231/2001).
- Remediation procedures and environmental emergencies: legal assistance in administrative procedures relating to: remediation procedures and safety of contaminated sites, throughout the whole procedural phase; waste disposal operations; opening of plants and establishments, including aspects connected to the assessment of urban plans and projects also of strategic importance (VAS, VIA and VINCA); and in general terms, assistance throughout all the requests and relationships with the Authority for the issue of environmental permits.
- Extraordinary Corporate Transaction and contractual assistance: assistance in regard to the transfer of industrial sites, the acquisition of shares and the sale of areas which often entail potential environmental liabilities, and also in insolvency proceedings; managing the environmental due diligence and drafting of specific environmental warranties, indemnity clauses and environmental covenants and contracts, including waste treatment and management, environmental services, REACH regulation, and investment transactions in environmental and energy projects.
- Environmental litigation: as a litigation team, we assist clients in all civil, administrative and criminal proceedings relating to environmental issues, including liability and compensation for damages arising from environmental offences, claims for compensation following acquisitions, and appeals to the administrative courts to challenge environmental measures.
